{"id":67170,"date":"2026-02-24T14:55:27","date_gmt":"2026-02-24T19:55:27","guid":{"rendered":"https:\/\/news2shorts.com\/index.php\/2026\/02\/24\/judge-holds-dhs-officials-in-contempt-orders-compensation-to-mexican-national-released-in-winter-storm\/"},"modified":"2026-02-24T14:55:27","modified_gmt":"2026-02-24T19:55:27","slug":"judge-holds-dhs-officials-in-contempt-orders-compensation-to-mexican-national-released-in-winter-storm","status":"publish","type":"post","link":"https:\/\/news2shorts.com\/index.php\/2026\/02\/24\/judge-holds-dhs-officials-in-contempt-orders-compensation-to-mexican-national-released-in-winter-storm\/","title":{"rendered":"Judge holds DHS officials in contempt, orders compensation to Mexican national released in winter storm"},"content":{"rendered":"<p>A federal judge <a href=\"https:\/\/www.foxnews.com\/category\/us\/us-regions\/midwest\/minnesota\" target=\"_blank\" rel=\"noopener\">in Minnesota<\/a> ruled on Monday to hold government officials in civil contempt for violating a judicial order that prohibited the U.S. Department of Homeland Security (DHS) from transferring detainee Fernando Gutierrez Torres, a Mexican national.<\/p>\n<p>U.S. District Judge Eric Tostrud, who was appointed by President <a href=\"https:\/\/www.foxnews.com\/category\/person\/donald-trump\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a> in 2018, found that despite an earlier order prohibiting Torres&#8217; transfer out of Minnesota, Immigration and Customs Enforcement (ICE) moved him to Texas without notifying his attorney.<\/p>\n<p>A judge granted Torres&#8217; habeas petition and ordered ICE to release him from custody &#8220;as soon as practicable, but not later than 48 hours&#8221; after the order was entered, according to court documents.<\/p>\n<p>Filings state a major <a href=\"https:\/\/www.foxnews.com\/category\/weather\/winter-storm\" target=\"_blank\" rel=\"noopener\">winter storm<\/a> in Texas led to a state of emergency declaration, and Torres&#8217; ICE-scheduled flight was canceled.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/federal-judge-strikes-large-parts-trump-mass-detention-policies-migrants\" target=\"_blank\" rel=\"noopener\"><strong>FEDERAL JUDGE STRIKES DOWN LARGE PARTS OF TRUMP MASS DETENTION POLICIES FOR MIGRANTS<\/strong><\/a><\/p>\n<p>The agency realized the earliest they could reschedule his return to Minnesota was Jan. 27, which would be past the 48-hour release deadline mandated by the court.\u00a0<\/p>\n<p>In a rush to comply with that 48-hour deadline, the agency decided to release him immediately in <a href=\"https:\/\/www.foxnews.com\/category\/us\/us-regions\/southwest\/texas\" target=\"_blank\" rel=\"noopener\">El Paso, Texas<\/a>, rather than waiting to fly him back to Minnesota.<\/p>\n<p>His belongings were allegedly withheld when he was freed, according to court documents.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/judge-threatens-contempt-ice-leader-orders-him-appear-court\" target=\"_blank\" rel=\"noopener\"><strong>JUDGE THREATENS CONTEMPT FOR ICE LEADER, ORDERS HIM TO APPEAR IN COURT<\/strong><\/a><\/p>\n<p>Tostrud ruled the haste to meet the deadline did not excuse the <a href=\"https:\/\/www.foxnews.com\/politics\/federal-judge-holds-doj-attorney-contempt-over-ice-case\" target=\"_blank\" rel=\"noopener\">agency&#8217;s contempt because ICE<\/a> should not have violated the original court order by transferring Torres to Texas in the first place, and ordered the government to pay for Torres&#8217; nearly $570 flight home, which was initially covered by his attorney.<\/p>\n<p>The government claimed the decision to transfer Torres was not made in &#8220;willful disregard for [sic] the Court&#8217;s order.&#8221;<\/p>\n<p>&#8220;It is undisputable the Agency needed to consult with the undersigned counsel before making the decision to release Petitioner in Texas,&#8221; attorneys wrote. &#8220;That did not happen. Respondent acknowledges [his] release in Texas was not in compliance with the expectations and Order of this Court.&#8221;<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/federal-judge-backs-away-from-threat-hold-ice-leader-contempt\" target=\"_blank\" rel=\"noopener\"><strong>FEDERAL JUDGE BACKS AWAY FROM THREAT TO HOLD ICE LEADER IN CONTEMPT<\/strong><\/a><\/p>\n<p>Government lawyers added they are &#8220;deeply remorseful&#8221; and offered their &#8220;sincere apologies for the situation.&#8221;<\/p>\n<p>Tostrud gave the administration an opportunity to file a motion for an <a href=\"https:\/\/www.foxnews.com\/category\/politics\/federal-judges\" target=\"_blank\" rel=\"noopener\">evidentiary hearing<\/a> before March 1, after which the judgment will go into effect.<\/p>\n<p>In addition, the government can identify the specific person or entity that violated the order.<\/p>\n<p>Court documents did not note what led to Torres&#8217; initial arrest, with the administration citing &#8220;alleged <a href=\"https:\/\/www.foxnews.com\/category\/us\/immigration\" target=\"_blank\" rel=\"noopener\">immigration-law violations<\/a>.&#8221;<\/p>\n<p><i>DHS did not immediately respond to Fox News Digital&#8217;s request for comment.<\/i><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge in Minnesota ruled on Monday to hold government officials in civil contempt for violating a judicial order that prohibited the U.S. Department of Homeland Security (DHS) from transferring detainee Fernando Gutierrez Torres, a Mexican national.
